- With your permission: for example, when we feature your review or photo.
4. Targeted Advertising and "Sale" or "Sharing"
We do not sell your personal information for money. However, we let advertising and analytics partners collect information through cookies and pixels on our website (such as your device data, pages viewed and purchases) so they can show you our ads on other websites and apps, retarget you and measure results. Our advertising partners are Meta (Facebook and Instagram), TikTok, Google, Pinterest, AppLovin and Taboola. Under some US state laws, this may count as a "sale" or "sharing" of personal information, or "targeted advertising".
In the last 12 months, the categories we may have "sold" or "shared" this way are: identifiers (such as IP address, cookie IDs and hashed email), commercial information (such as products viewed and bought) and internet activity (such as pages viewed). We do not knowingly sell or share the personal information of anyone under 16.
Do Not Sell or Share My Personal Information
You can opt out of the sale or sharing of your personal information and of targeted advertising at any time:
- Who this covers: your opt-out stops us from sharing your information with Meta, TikTok, Google, Pinterest, AppLovin and Taboola for targeted advertising.
- Online: use our opt-out page at https://exchange-life.com/pages/data-sharing-opt-out.
- By email: send "Do Not Sell or Share" to hello@exchange-life.com.
- Global Privacy Control: if your browser sends a Global Privacy Control (GPC) signal, we treat it as a valid opt-out request for that browser.
You can also limit ads through the tools of each platform, such as Meta Ad Preferences, TikTok Ads settings, Google Ad Settings and Pinterest privacy settings, or industry tools at https://optout.aboutads.info and https://optout.networkadvertising.org.
5. Cookies and Pixels
Cookies are small files stored on your device. Pixels and tags are small pieces of code that send information to us or our partners when you visit a page. We use them for these purposes:
- Necessary: to run the store, keep your cart and let you check out and log in. These can't be turned off.
- Analytics and preferences: to understand how the website is used and to remember your settings (Google Analytics, Microsoft Clarity, ABConvert, Upstack Data, Ybug and Shopify analytics).
- Marketing: to show, retarget and measure ads (Meta, TikTok, Google, Pinterest, AppLovin, Taboola, OpenAI and Klaviyo).
Where the law requires it, for example in the EU and UK, we ask for your consent before we use non-necessary cookies. You can change your choices at any time through our cookie banner or your browser settings. Blocking some cookies may stop parts of the website from working.
Some browsers send a "Do Not Track" signal. There is no common standard for it, so we don't respond to it. We do respond to Global Privacy Control as described in Section 4.
6. Emails, Text Messages and WhatsApp
- Emails: you can unsubscribe at any time using the link in any marketing email. We will still send order and membership emails.
- Text messages: if you opt in to texts, message and data rates may apply. Reply STOP to stop or HELP for help. Your consent is not a condition of purchase.
- WhatsApp: if you message us on WhatsApp, we use the chat to help you. WhatsApp also processes the messages under its own privacy policy. You can ask us at any time to stop messaging you there.
7. Your US State Privacy Rights
If you live in California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon or another US state with a consumer privacy law (such as Montana, Iowa, Delaware, Nebraska, New Hampshire, New Jersey, Tennessee, Minnesota, Maryland, Indiana, Kentucky and Rhode Island), you may have these rights, depending on your state:
- Know and access: ask what personal information we have about you and get a copy.
- Correct: ask us to fix information that is wrong.
- Delete: ask us to delete your personal information.
- Portability: get your information in a format you can move to another service.
- Opt out: of the sale or sharing of your information, targeted advertising and profiling (see Section 4).
- Limit sensitive information: we do not use sensitive personal information to infer things about you.
- No discrimination: we will not treat you worse for using your rights.
How to use your rights
Email hello@exchange-life.com with the subject "Privacy Request", or call us at +1 (321) 478-2909. Tell us what you want us to do. To protect you, we check your identity by matching details such as your email address and a recent order number. You can use an authorized agent; we may ask for proof that they can act for you. We respond within 45 days. If we need more time, we will tell you, and we may take up to 45 more days where the law allows. There may be reasons we can't fully meet a request, for example if we must keep records by law. We will explain why.
Appeals
If we deny your request, you can appeal by replying to our decision or emailing hello@exchange-life.com with the subject "Privacy Appeal". We answer appeals within 45 days (60 days in Colorado). If you disagree with our answer, you can contact the Attorney General of your state.
Financial incentives
We sometimes offer discounts or other benefits when you sign up for our emails or texts, or join our membership (for example, a member discount code). To get them, you give us your email address or phone number. We think the value of these offers is reasonably related to the value of the marketing and customer relationship we get from your information. Taking part is optional, and you can unsubscribe or cancel at any time.
California "Shine the Light"
California residents can ask once a year whether we shared personal information with others for their own direct marketing. We do not do this.
8. Visitors from the EU, EEA, UK and Switzerland
If you live in the EU, EEA, UK or Switzerland, the General Data Protection Regulation (GDPR), the UK GDPR or Swiss law may apply to you.
Legal bases
- Contract: to process your order, membership and support requests.
- Consent: for marketing emails and texts and for non-necessary cookies and pixels. You can withdraw your consent at any time.
- Legitimate interests: to improve our website, prevent fraud and handle disputes, where your rights do not override these interests.
- Legal obligation: to keep tax and accounting records and follow the law.
Your rights
You have the right to access, correct, delete, restrict or move your personal information, to object to how we use it (including for direct marketing), and to withdraw consent. To use these rights, contact us as described in Section 7.
Complaints to an authority
You can complain to the data protection authority in the country where you live or work, or where you think the problem happened. We would appreciate the chance to help first, so please contact us.
9. International Transfers
We are based in the United States, and our team and service providers work in several countries, including the United States and China (where our products are made and shipped from). Your information may be processed outside the country where you live. When we transfer information from the EU, EEA, UK or Switzerland, we use legal safeguards such as the European Commission's Standard Contractual Clauses, or rely on our service providers' safeguards, such as the EU-US Data Privacy Framework.
10. How Long We Keep Your Information
- Orders, payments and tax records: 7 years after the order, because tax and accounting laws require it.
- Membership records: while you are a member, and 3 years after your membership ends, to handle billing questions and disputes.
- Customer support messages: 3 years after your last contact with us.
- Marketing lists: until you unsubscribe. After that, we keep your email or phone number on a "do not contact" list so we don't message you again.
- Analytics and cookie data: up to 26 months, or as set out by each tool.
- Affiliate records: 3 years after you leave the affiliate program.
We may keep information longer if the law requires it or to resolve a legal claim.
11. Children
Our website is not meant for children under 13, and we do not knowingly collect personal information from children under 13. We do not knowingly sell or share the personal information of anyone under 16. If you think a child has given us personal information, contact us and we will delete it.
12. Security
We use reasonable safeguards to protect your information, such as encrypted checkout, access controls and trusted service providers. No method of sending or storing data is 100% secure, so we can't guarantee complete security. Please keep your account login private.
13. Third-Party Websites and Platforms
Our website and member groups link to other services, such as WhatsApp, Facebook, Instagram, TikTok and Trustpilot. Their own privacy policies apply when you use them.
14. Changes to This Policy
We may update this policy from time to time. We will change the "Last updated" date at the top. If we make important changes, we will tell you by email or with a notice on our website.
15. Complaints
If you have a concern about how we handle your personal information, please contact us first using the details below. We will try to fix it quickly. You can also contact the Attorney General of your US state or, if you live in the EU, EEA, UK or Switzerland, your local data protection authority.
