Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law. These Products are provided for decorative purposes only and do not represent any political position, endorsement, or affiliation. You acknowledge and agree that the public display, possession, or wearing of certain flags, maps, or national symbols may be legally restricted, politically sensitive, or socially controversial in specific jurisdictions or environments.

By purchasing such products from Exchange Life, you assume all legal, physical, and personal responsibility and risk associated with the possession, wear, and display of such items. To the fullest extent permitted by applicable law, Exchange Life LLC, its affiliates, suppliers, and representatives shall not be held liable for any legal consequences, fines, confiscations, personal injury, property damage, disputes, or other adverse outcomes resulting from your decision to wear or display our products.

It is solely your responsibility to understand and comply with the local laws, regulations, and social norms of any jurisdiction in which you reside or travel while possessing our products. You agree to indemnify and hold Exchange Life LLC harmless from any claims, damages, or liabilities arising from your use or display of the products.

This section applies to all current and future Products of a similar nature.

Nothing in these Terms shall affect any mandatory consumer rights you may have under the laws of your country of residence. In case of conflict, such mandatory rights shall prevail.

You agree to indemnify, defend and hold harmless Exchange Life LLC and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

17. Severability

20.1 Contact Us First

Most problems can be fixed quickly. Before you start any claim, you agree to send us a written notice by email to hello@exchange-life.com. Include your name, your order number (if any), a short description of the problem and what you want. We will do the same if we have a claim against you. We both agree to try in good faith to settle the issue for 60 days after the notice is received. During that time, neither of us will start an arbitration or court case, except to stop a deadline from running out.

20.2 Who This Applies To

Sections 20.3 to 20.9 apply to customers in the United States. If you live outside the United States, you keep any right under the mandatory laws of your country to bring a claim in your local courts.

20.3 Binding Arbitration

If we can't settle the issue, any dispute between you and Exchange Life LLC that relates to these Terms, our website, our products or our services will be decided by binding individual arbitration, not in court. Arbitration uses a neutral arbitrator instead of a judge or jury. The arbitrator can give you the same individual relief a court could.

20.4 Arbitration Provider and Rules

The arbitration will be run by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules in effect when the claim is filed. The rules are available at https://www.adr.org. If the AAA can't or won't handle the case, we will agree on another provider, or a court will pick one.

20.5 Location, Hearings and Costs

• Remote hearing: any hearing will take place by video or phone, unless the arbitrator decides an in-person hearing is needed. An in-person hearing will take place in the county where you live, or another place we both agree on.
• Smaller claims: if your claim is for $25,000 or less, you may choose to have it decided only on written documents.
• Fees: fees are paid as set out in the AAA Consumer Arbitration Rules and fee schedule. Your filing fee will not be more than the fee to file in court. We pay the rest of the AAA and arbitrator fees, unless the arbitrator finds your claim was frivolous.

20.6 Small Claims Court

Either of us may instead bring an individual claim in small claims court in your county or in Delaware, if the claim qualifies and stays there.

20.7 No Class Actions

You and we each agree to bring claims only on an individual basis. Neither of us may bring or take part in a class action, class arbitration, collective action or representative action. The arbitrator may not combine more than one person's claims, except as allowed in Section 20.8. If a court decides this class action waiver can't be enforced for a certain claim, that claim (and only that claim) will be decided in court, and Section 20.3 will not apply to it. Any claim for public injunctive relief will be decided in court after the individual arbitration is finished, where the law requires that.

20.8 Mass Filings

If 25 or more similar arbitration demands are filed against us or by us by the same or coordinated lawyers or organizations, the AAA's Mass Arbitration Supplementary Rules will apply. The cases may be handled in batches, and the AAA fees will be charged according to those rules. Both sides agree to work in good faith with the AAA to handle these cases fairly and quickly. The deadline to bring any claim is paused while this process runs.

20.9 Your Right to Opt Out

You can opt out of this arbitration agreement. To do so, send an email to hello@exchange-life.com within 30 days after you first accept these Terms (for example, by placing your first order). Include your name, the email address you used with us, and a clear statement that you want to opt out of arbitration. Opting out does not affect any other part of these Terms. If you opt out, or if Sections 20.3 to 20.9 don't apply to you, disputes will be heard in the state or federal courts located in Delaware, unless the law where you live gives you the right to use your local courts.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

22. Customs, Duties, and Taxes for All Countries Outside the US, UK, Australia, and Norway

Your order will be shipped from outside your destination country, and we are not responsible for any customs duties or taxes applied to your order. We do not collect VAT or GST. Any fees imposed during or after shipping, such as tariffs, taxes, VAT, or GST, are your sole responsibility.

Each offer on our website contains such information that it is clear to the consumer what rights and obligations are associated with accepting the offer. This concerns, particularly the price, excluding customs duties and (import) VAT or GST. These additional costs will be borne by you. The postal and/or courier service will use the special arrangement for postal and courier services regarding customs clearance. 23. U.S. Orders – Customers, Shipping & Legal Terms

The terms in this section apply exclusively to orders shipped to the United States.

All products sold through this website are shipped directly from our overseas fulfillment partner located outside the United States.

Title and risk of loss pass to you, the customer, when we deliver your order to the shipping carrier at our fulfillment partner outside the United States. This happens before the goods enter the United States.

Exchange Life LLC does not act as the importer of record. All importation, duties, and customs clearance are arranged and handled either by the supplier or the shipping carrier on behalf of the customer. Our company does not own or warehouse any goods within the U.S., nor does it take part in U.S. customs filings or import procedures.

All products are manufactured and fulfilled abroad and sold on a delivered-from-abroad basis. We operate as an online retailer sourcing products from third-party suppliers.

Exchange Life LLC does not engage in a trade or business within the United States. The company has no offices, employees, agents, or fixed place of business in the U.S. and does not conclude contracts within the United States.

24. Shipping, Delivery and Risk

Unless otherwise stated, all orders are shipped from international fulfillment centers. Title to products and risk of loss pass to you when we deliver your order to the shipping carrier. This does not limit the help described in our Refund Policy, for example for damaged or wrong items.

We are not responsible for delays, losses, or damages caused by shipping carriers, customs authorities, or events beyond our control.

You are responsible for ensuring that products can be lawfully imported and used in your jurisdiction.

25. Force Majeure

We shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, war, armed conflict, terrorism, riots, civil unrest, strikes, government actions, embargoes, blockades, sanctions, failures of utilities or telecommunications, shipping delays, customs actions, or supply chain disruptions.

In such cases, our obligations shall be suspended for the duration of the event, and we shall be entitled to a reasonable extension of time to perform our obligations.

27. Chargebacks and Payment Disputes

If you have a problem with an order or a charge, please contact us first at hello@exchange-life.com before you dispute the charge with your bank, card company, PayPal or another payment provider. Most issues can be fixed faster this way, and we will do our best to resolve them quickly.

If a charge is disputed, we may share order, shipping, tracking and message records with the payment provider to respond to the dispute.

If we find that a dispute was fraudulent or abusive, we may refuse future orders, to the extent the law allows.

Nothing in this section limits your right to dispute a charge with your bank or card company, or any other right you have under the law, including for unauthorized or fraudulent charges.

28. Membership and Subscriptions

We offer the Exchange Life Travel Community Membership. It is a monthly subscription that renews automatically until you cancel. New members get a 7-day free trial. If you don't cancel before the trial ends, we charge your payment method the monthly price shown at checkout, plus any taxes, and then again every month until you cancel.

You can cancel at any time in your account, by email or by WhatsApp. Our Cancellation Policy explains what the membership includes, how billing works, how to cancel, what happens when you cancel and how we tell you about price changes. The Cancellation Policy is part of these Terms.

Membership charges are covered by our 60-day money-back guarantee. You can ask for a full refund of any membership charge within 60 days of that charge, as explained in our Cancellation Policy and Refund Policy.

The member groups on WhatsApp and Facebook are run on those platforms, and their own terms also apply. Please be respectful. We may remove anyone who harasses others, spams or breaks these Terms, and we will stop billing them.

29. Affiliate Program Terms & Conditions

By signing up for our Affiliate Program, using the affiliate link provided post-purchase, or using any other affiliate link associated with our brand, you agree to the following terms:

29.1 No Paid Advertising

You are strictly prohibited from running any form of paid advertising that directs traffic to your affiliate link or any page containing your affiliate ID. This includes, but is not limited to:

• Meta Ads (Facebook/Instagram)
• Google Ads (Search, Display, Shopping, etc.)
• TikTok Ads
• Pinterest Ads
• Any other paid media platform

Zero-Tolerance Enforcement: If we determine, or reasonably suspect, that you are sending paid traffic to your affiliate link, we reserve the right to withhold, cancel, and permanently forfeit any and all affiliate commissions, without notice and without the obligation to provide proof.

Reasonable suspicion includes, but is not limited to, being flagged in Social Snowball as "appeared to be from ads."

29.2 Prohibited Affiliate Activities

The following affiliate activities are strictly prohibited. Violating any of these will result in permanent removal from the program and immediate forfeiture of all pending and future commissions:

• Coupon & Discount Code Sites: Listing our affiliate links or discount codes on coupon sites such as Honey, Capital One Shopping, RetailMeNot, or similar platforms.
• Trademark Bidding: Bidding on our brand name (or close variations) in paid search ads (e.g., Google Ads, Bing Ads).
• Domain / Typo-Squatting: Registering domains that mimic or closely resemble our brand name to redirect traffic to affiliate links.
• Toolbar, Extension, or Adware Use: Using browser extensions or software that inject affiliate links, pop-ups, or banners without explicit user consent.
• Incentivized Traffic: Offering users rewards, cashback, giveaway entries, or any form of incentive to click or buy through your affiliate link.
• Misrepresentation of Brand: Pretending to represent our brand, using our logo, brand name, or tone without permission, or misleading users into believing you're officially affiliated.
• Unauthorized Email Use: Sending affiliate links through scraped email lists or to existing customers of our brand.
• Rebrokering / Sub-Affiliate Networks: Enrolling others into the program under your ID or funneling traffic through other affiliate networks without our approval.
• Fake Accounts / Bot Traffic: Using bots, fake accounts, or automation tools to drive traffic, clicks, or purchases.

29.3 Enforcement and Disqualification

We reserve full discretion to:

• Deny or withhold commission payments.
